    Received an Air Quality Notice of Violation? What Industrial Operators Should Do in the First 30 Days

    A Notice of Violation lands on your desk. Maybe it followed a stack test failure, a CEMS data gap, an opacity reading during an inspection, or a records review that turned up excess emission events you thought were minor. Whatever triggered it, the clock is now running, and what your facility does in the next 30 days shapes everything that follows: the penalty exposure, the corrective action you will be held to, and how the agency treats you for years afterward.

    This guide walks through the first 30 days from an operator's perspective. One note up front: an NOV has legal dimensions, and your environmental counsel should be involved early. What follows is the operational and technical side, the part that determines whether your response is credible.

    First, Understand What You Are Actually Holding

    In the US, an NOV can come from your state or local air agency or from EPA directly, typically citing conditions of your Title V or state operating permit, NSPS/NESHAP standards, or SIP requirements. In Canada, the equivalent may be a warning letter, environmental protection compliance order, or director's order from Environment and Climate Change Canada or a provincial regulator (Ontario's MECP against your ECA, Alberta's approval conditions, and so on). The mechanics differ; the playbook below does not.

    Read the notice line by line and pull out four things:

    • The specific alleged violations: permit condition numbers, rule citations, and the dates or date ranges cited. Vague understanding here leads to a vague response, and agencies notice.

    If the underlying issue is still occurring (an RTO running below its permitted minimum combustion chamber temperature, a bypass damper not sealing, a broken CEMS feed, a scrubber out of range), get the equipment issue contained first. That may mean curtailing the affected line, running at reduced rates, or bringing in emergency service on the control device. Continued operation in a known violation state multiplies penalty exposure, because most agencies count violations by the day.

    Preserve every record that touches the cited period

    Pull and protect: CEMS and data historian records, chart recorder or PLC temperature logs from the oxidizer or control device, maintenance work orders, calibration records, stack test reports, deviation reports, malfunction logs, and operator rounds sheets for the cited dates. Put a litigation-hold mindset on it: nothing gets overwritten, nothing gets cleaned up. Data historians and CEMS DAS systems often purge or compress data on a schedule; interrupt that now.

    Environmental counsel, your insurance carrier if applicable, corporate EHS, and plant leadership. Decide on day one who owns the response: one accountable person, usually the EHS manager or plant manager, with engineering and legal supporting. NOV responses drift when ownership is fuzzy.

    Days 4 to 10: Root Cause, Not Blame

    The agency does not just want to know what happened, it wants to know why, and whether your explanation demonstrates you actually understand your own equipment. This is where most NOV responses are won or lost, and it is fundamentally a technical exercise.

    Common root causes we find when facilities dig into air compliance events:

    • Control device degradation: plugged or channeled RTO ceramic media dropping destruction efficiency, degraded valve seals allowing untreated bypass, burner performance drift pulling combustion chamber temperature below permit minimums.
    • Monitoring failures: CEMS analyzers out of calibration, thermocouples reading wrong or failed, data feeds dropping out so required parameters simply were not recorded. A monitoring gap is itself a violation under most Title V permits, even if actual emissions were fine.
    • Operating outside the tested envelope: production rates, line speeds, or solvent loading that crept above what the last stack test represented.
    • Procedural gaps: missed preventive maintenance on the permit's required schedule, missing calibration documentation, deviation events that were never reported within the required window.

    Bring in a qualified combustion or air pollution control service team to inspect and diagnose the equipment if the root cause is not obvious from records. An independent inspection report also strengthens your written response: it shows the agency you took the notice seriously enough to put professionals on it.

    Days 11 to 20: Build the Corrective Action Plan

    Your corrective action plan is the core of the response. Strong plans share the same anatomy:

    • Immediate actions already taken: what you did in week one to stop or contain the issue. Completed actions carry more weight than promised ones.
    • Root cause, stated plainly: technical, specific, and honest. "The RTO's poppet valve seals had degraded, allowing partial bypass during valve cycling; destruction efficiency fell below the permitted 98%" beats three paragraphs of hedging.
    • Permanent corrective measures with dates: media replacement, valve rebuilds, burner retrofit, CEMS upgrades, revised PM schedules, each with a responsible party and a realistic completion date. Agencies hold you to these dates; do not promise a six-week equipment lead time in three.
    • Prevention and verification: how you will confirm the fix worked (retest, performance verification, parametric monitoring) and how you will catch drift earlier next time (inspection intervals, trending pressure drop and temperature, alarm setpoints).

    If compliance cannot be restored quickly (say a rebuild requires a planned outage or long-lead equipment), propose an interim operating plan and a compliance schedule. Agencies work with operators who bring realistic schedules; they escalate on operators who go quiet.

    Days 21 to 30: Respond in Writing, Then Meet

    Submit the written response before the deadline, signed by the responsible official, answering every element the NOV raised. Where you agree with the facts, say so and point to your corrective actions. Where the agency has facts wrong (wrong dates, misread data, an averaging-period error), correct the record respectfully with documentation attached. Have counsel review the final draft; admissions in an NOV response can carry into penalty negotiations.

    Then request a meeting or conference if one is not already scheduled. Face-to-face (or call) discussions consistently produce better outcomes than paper exchanges: they let you demonstrate competence, walk through the corrective plan, and negotiate schedules and, eventually, penalty terms.

    What Not to Do

    • Do not ignore it or blow the deadline. Silence converts a manageable NOV into escalated enforcement.
    • Do not submit a defensive, blame-shifting response. Regulators read hundreds of these; accountability plus a credible plan is what earns cooperation.
    • Do not "fix" the records. Altered data turns a civil matter into something far worse.
    • Do not patch the symptom and skip the root cause. A unit that generates a second NOV for the same issue puts you in the repeat-violator category, where penalties multiply and consent orders follow.

    The pattern behind most air quality NOVs is the same: a control device or monitoring system degraded gradually, nobody was trending the early indicators, and a stack test or inspection caught it before the facility did. The cheapest NOV response is the inspection and maintenance program that prevents the next one.
